FCA files precautionary appeal in business interruption test case

The regulator filed a ‘leapfrog’ application in case an agreement to pay out Covid-19 claims is not reached with the insurers

The Financial Conduct Authority has appealed the judgement handed down in its Covid-19 business-interruption insurance test case earlier this month — but stressed the move is only a “precaution” in case it cannot agree outstanding issues with insurers.

The appeal, called a “leapfrog” application, was made on a precautionary basis as businesses across the UK wait to hear if their business interruption claims following the nationwide lockdown will be paid.
