M&S wins EU tax case

The EU's highest court has ruled that UK retailer Marks & Spencer should be allowed to offset losses incurred by foreign subsidiaries against its domestic tax burden.

AFX reports that the court said UK tax law, which refuses to allow companies to offset tax losses from overseas subsidiaries against UK profits, "constitutes a restriction on freedom of establishment".
