Most companies settle out of court to avoid ‘blackmail' cases

If shareholders win damages from their own company through a class action, is that not robbing Peter to pay Paul? Is it not their own money they are winning?

If only some investors sue and win – the US shareholders if the UK holders decline to join the class action – they are winning other people's money as well as their own. But it is likely to be former shareholders who sue because they have to demonstrate their loss.
