Mutual fund defeat for Spitzer

Eliot Spitzer, the New York state attorney general, has suffered his second legal defeat against Theodore Sihpol, the former Bank of America broker he charged with improper trading. He has now dropped all criminal charges against Sihpol.

Spitzer's decision came after Sihpol settled a separate civil lawsuit with the Securities and Exchange Commission in relation to allegations of improper trading.
